These terms govern access to and use of the platform Blogify including the website, the application and the services, offered by swapps (we). By accessing the platform, you acknowledge you have read and agreed to these terms of service.
We reserve the right to change the platform website, application, services, pricing, terms of service or any other element, at our sole discretion, with or without prior notice. If you do not agree with a change, you should cancel your usage of the platform, and we will refund you any unspent amount as per section 8.
Blogify is a Software As Service Platform (SaaS) which allows to create and host a website from a social media account.
Blogify is provided by swapps, a company headquartered in Yaounde, Cameroon.
You have a non-exclusive, non-transferable, revocable, limited, personal right to access and use the platform.
You have the right to report us any content you find harmful on the platform or on any hosted website, using the Reporting form at the bottom of the platform website.
You are fully responsible of any content you post on the platform or on a hosted website, for example a comment.
You are fully responsible to protect yourself and the device through which you connect from any content on the platform or on a hosted website.
For any content published on a hosted website, you agree to look solely to the website owner for any damage resulting from a purchase or use of the content.
You must not reverse engineer, decompile, disassemble or attempt to derive source code from the platform.
You must be of legal age in your country of residence when opening a user account on the platform.
If you open an account on behalf of a third party, you agree you are authorized to bind that third to these terms and to act as such.
You are fully responsible to provide and maintain correct and accurate information on your account, and any website you create.
You are fully responsible of any access and use of the platform through your account. You must immediately notify us for any unauthorized access or use of the platform from your account, using the Reporting form at the bottom of the platform website.
You are fully responsible for any content published on your website, and any harm resulting from. This includes but is not limited to offensive or indecent content; inaccuracy, mistake or error in content; privacy, intellectual property rights infringement.
You are fully responsible to provide and maintain a primary email address, which is not bound to any domain you purchased on the platform, to receive all communications about your account and hosted websites.
We are responsible to provide you support on the platform access and usage, over Support channels listed at the bottom of its website and in the limit of our availability.
We reserve the right to limit or suspend access to, usage of, operation of the platform or any hosted website for a scheduled or emergency maintenance, with or without prior notice.
We do not review nor endorse any content published on a hosted website. A link to blogify.site does not imply an endorsement of the hosted website.
We have no responsibility for any exchange between a visitor and a hosted website.
We reserve the right to review any reporting submitted to us, and to take appropriate measures with or without prior notice.
We have the right to refuse service or suspend your account or any owned website if we find, at our sole discretion, any unauthorized use of the platform, or violation of these terms. We will refund you any unspent amount as per section 8.
The platform relies on various third party web services to provide some features. We are not responsible of any of them, nor make any representation or warranty with respect to them. You use them at your own risk.
The platform may offer third party products and services within your website dashboard. Such products and services may be subject to the terms of service of the third party provider. We are not responsible of any of those products or services, nor make any representation or warranty with respect to them. You use them at your own risk.
The platform costs are outlined for each product or service where appropriate, before a purchase.
Various payment methods are available on the platform, and listed depending of your country of residence to purchase with.
Most of the platform products or services are subscription based. You are fully responsible to extend any active subscription before it expiration date. There are also one-time based products or services, purchased once.
An expired subscription may automatically result in the suspension of the given service or a lost of privileges.
Hosting packages are monthly subscription based, and billed for each 30 (thirty) days interval from its initial subscription date.
We reserve the right to change any price at any time, with a prior notice of 30 (thirty) days before the update takes effect. You are fully responsible to ensure your account primary email address receives all our communications as per section 3.
We respect intellectual property rights of third parties. If you find the platform or any hosted website infringes your rights, please use the Reporting form available at the bottom of the platform website to notify us.
You retain all rights on any content published on your website. You warrant that you have all rights to publish that content and it does not infringe the rights of a third party.
You agree swapps uses, without restriction and royalty-free, any content published on your website for the purpose of providing, supporting, improving and promoting its platforms.
swapps retain all rights on Blogify.
You can request a cancellation of any subscription based product or service at any time, using the Reporting form at the bottom of the platform website.
The validity of a cancellation is determined at our sole discretion, and will be confirmed to you before any action is taken.
If valid, you still have full responsibility to pay all charges accrued prior to the effectiveness of the cancellation.
If you subscribed a hosting package on September 30, for 3 months and it is cancelled on October 15, we will refund you the monthly fees for 2 months minus any other charges accrued on a product or service by the cancellation date.
You cannot cancel one-time payment, unless it is a mistake from the platform.
You cannot cancel a subscription paid under a promotion.
From the initial subscription to a hosting package for a new website, you can choose a domain name for free. Depending of the number of months subscribed, you choose a domain extension from a predefined list. That list is subject to change at any moment and at our sole discretion, without prior notice.
You can separately subscribe any domain name from a predefined list, at a regular price as fixed by the platform. You are fully responsible to extend it before it expires, at a 12 (twelve) months interval from its initial subscription date.
If your hosting package subscription expires, you automatically loose the eligibility for the free domain name offer. You will have to purchase the domain name offered at the regular price fixed by the platform to get it back.
If your hosting package is cancelled before a 12 (twelve) months interval from its initial subscription date, you are charged for the domain name offered at the regular price as fixed by the platform.
swapps provides Blogify as is, without any warranty.
You agree to access and use the platform at your own risk.
swapps is not liable to you in any case for any damage arising from your use of the platform.
Any claim of any kind must not exceed the fees we received from you for the service subject to the claim.
You agree to defend and indemnify swapps against all claim, loss, damage, penalty, liability and cost of any kind that are in connection with or arising out of a complaint alleging that your website infringes or violates the intellectual property rights, privacy rights or other rights of a third party, or any applicable law.
The terms and any dispute arising out of them are governed by the laws of Cameroon.
